Cosmetic Surgery
Medical negligence solicitors have seen a steady increase in claims procedures arising from cosmetic surgery. During the course of the last decade there has been rapid and sustained growth in the cosmetic surgery industry with well over 50,000 surgical procedures being carried out annually. These operations are mainly carried out on a private basis and over £200 million is spent on cosmetic procedures every year. The vast majority of people choosing to undergo cosmetic surgery are women however, the number of men opting to have these procedures is dramatically rising year by year.
Inadequate Care
Most surgical operations are performed correctly and carefully by qualified surgeons assisted by capable and experienced staff however, this is not always the case and on occasions patients suffer injuries. Where there has been negligence, surgical errors and inadequate care commonly leave patients with bleeding and infected wounds and subsequently with severe scarring which often also results in psychological trauma coupled with a lack of self-confidence. Negligence occurring during cosmetic procedures is not an isolated experience with about 20% of private healthcare patients have cause for complaint to medical negligence solicitors.
The Law
Whilst there is now central government control of private cosmetic surgery clinics by virtue of the Care Standards Act 2000 which established the National Care Standards Commission whose duty is to monitor all private clinics on behalf of the Department of Health unfortunately training and qualification regulations only applies to doctors registering after 1st April 2002. Doctors who were in practice prior to that cut off date are entitled to continue in practice without undergoing any subsequent specialist training.
Inadequate Explanation
Whilst most of the claims that medical negligence solicitors deal with relate to inadequate surgical procedures or aftercare particularly for facial or breast surgery there is a significant number of claimants who suffer a less than satisfactory result and who were not warned that the surgery is not always totally successful. The failure to outline risks in advance of failed surgery is negligence and can result in the payment of considerable compensation.
